Damit ist die Frage der erforderlichen Verknüpfung zwischen der zunächst nur riskanten Handlung und der weiteren Zuspitzung der wirtschaftlichen Krise angesprochen: Hängt die Bestrafung des Spielers, der den Verlust seines Einsatzes in Kauf nimmt, wirklich vom konkreten Pech im Spiel ab oder bleibt der Spieler umgekehrt straffrei, wenn ihm das Glück carry ist und er das Spiel gewinnt und so einen Zusammenbruch verhindert? Aus der Zweckbindung des Gesellschaftsvermögens folgt darüber hinaus, dass dieses den Gesellschaftern nicht nach Bruchteilen, sondern zur gesamten Hand zugewiesen ist. Verletzt im Sinne der §§ 171, 172 StPO ist danach die Gruppe der Anteilseigner.
